Terms of Service

These Terms of Service (“Terms”) form a legal agreement between you and RacingStatto (“we”, “us”, “our”) governing your access to and use of the RacingStatto website, dashboard, and related services (the “Service”).

By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.

You must be at least 18 years old and capable of entering into a binding contract in your country of residence to use the Service. By using the Service you confirm that you meet these requirements.

You are responsible for the information you provide when registering, for keeping your credentials confidential, and for all activity on your account. Please notify us immediately at support@racingstatto.com if you suspect unauthorised access.

Accounts are personal to you. You must not share your account with anyone else, and you must not create multiple accounts to circumvent usage limits or restrictions.

Paid features of the Service are provided on a subscription basis. By subscribing you authorise us (and our payment processor, Stripe) to charge your chosen payment method the applicable fees, taxes, and any renewal charges.

Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time from your account settings or via the Stripe billing portal.

We may change subscription pricing from time to time. Price changes take effect at your next renewal and we will give you reasonable notice before they apply.

Our refund and cancellation policy is set out in our Refund & Cancellation Policy, which forms part of these Terms.

When using the Service you must not:

• break any applicable law or third-party rights;
• attempt to gain unauthorised access to any account, system, or data, including by probing, scanning, or circumventing our security;
• use bots, scrapers, or other automated tools to extract content, statistics, or data from the Service at scale;
• resell, sub-licence, or redistribute access to the Service, whether for consideration or otherwise;
• upload or transmit malware, or anything that disrupts the Service; or
• use the Service to harass, abuse, or harm others.

RacingStatto is a statistics and data analysis platform. Nothing on the Service constitutes betting, gambling, investment, or financial advice, and nothing is a recommendation to place any wager. All ratings, projections, and analysis are provided for informational and research purposes only.

Horse racing is unpredictable and outcomes cannot be guaranteed. We make no warranty that the statistics or analysis available through the Service are accurate, complete, or suitable for any particular purpose. If you choose to use information from the Service to inform any wager, you do so entirely at your own risk.

The Service, including all software, content, data, statistics, and branding, is owned by or licensed to Racing Statto and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your own personal, non-commercial use while your account is active. All other rights are reserved.

If the Service lets you submit content (for example, notes, preferences, or profile information), you retain ownership of it. You grant us a worldwide, royalty-free licence to host, store, and display that content as necessary to operate and provide the Service to you.

You can close your account at any time by contacting us or using the account settings. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if there is credible evidence of fraud, abuse, or security risk.

On termination your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination will do so.

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Service is limited to the amount you have paid us in the twelve months preceding the event giving rise to the claim. We exclude liability for indirect, incidental, consequential, special, or punitive damages, and for loss of profits, revenue, or data.

Nothing in these Terms limits any liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, or for fraud.

We may update the Service and these Terms from time to time. When we make a material change we will update the “last updated” date above and, where appropriate, notify you by email or in-app. Continued use of the Service after a change constitutes acceptance of the updated Terms.

These Terms are governed by the laws of England and Wales. You and we submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute arising out of or in connection with these Terms, except that you may also be entitled to bring proceedings in the courts of your country of residence where required by mandatory consumer law.
